1. Acceptance of Terms

By installing or using the Ember PDF browser extension, or by visiting emberpdf.com, you agree to be bound by these Terms of Service. If you do not agree with them, do not install the extension and do not use the website. Ember PDF reserves the right to update these terms as described in section 12.

2. Description of Service

Ember PDF is a free browser extension that merges, splits, extracts pages from, rotates, resizes, compresses and converts PDF files, and converts between PDFs and image files. All processing takes place locally within your own browser; no documents are uploaded to us or to any third party.

The extension is distributed through the Mozilla Firefox Add-ons marketplace at addons.mozilla.org. The website at emberpdf.com provides information about, and support for, the extension. The extension may also set its search provider to search.emberpdf.com, subject to the prompt your browser presents at install time, which you may decline.

3. Permitted Use

Ember PDF is provided for personal, non-commercial use. You agree that you will not:

• Reverse engineer, decompile or disassemble the extension, except where that right cannot be excluded by applicable law;
• Modify, adapt or create derivative works from the extension;
• Redistribute, resell, sublicense or republish the extension or any part of it;
• Use the extension to process material you have no legal right to process, or for any unlawful, infringing or fraudulent purpose;
• Attempt to interfere with, disrupt or gain unauthorised access to the extension, the website or their supporting systems.

You are solely responsible for the documents you process and for ensuring you hold the necessary rights to do so.

4. Intellectual Property

Ember PDF retains all right, title and interest in and to the extension and the website, including the source code, the name, the logo, the icons and all other assets. Nothing in these terms transfers ownership of any intellectual property to you. Third-party open source libraries bundled within the extension remain subject to their own respective licences.

5. Privacy

Your use of the extension and the website is subject to our Privacy Policy, available at emberpdf.com/privacy/, which is incorporated into these terms by reference. It explains what limited data is collected and confirms that the documents you process are never transmitted to us.

6. Disclaimer of Warranties

The extension and the website are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the extension will be uninterrupted, error-free, or compatible with every document, and we do not warrant that any particular result will be achieved. You are responsible for keeping copies of your original files. Some operations are lossy by design, including aggressive compression, which permanently removes selectable text; the extension warns you before running such an operation, and proceeding is your decision.

7. Limitation of Liability

To the fullest extent permitted by law, Ember PDF will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, documents, profits, revenue or goodwill, arising out of or relating to your use of or inability to use the extension or the website, whether based in contract, tort, negligence, strict liability or any other theory, and whether or not we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these terms is limited to the greater of the amount you actually paid us for the extension, which for this free extension is zero, or ten United States dollars (USD 10.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Where that is the case, the exclusions and limitations above apply only to the extent permitted by the law that applies to you, and your mandatory statutory rights are not affected.

8. Indemnification

You agree to indemnify, defend and hold harmless Ember PDF and its operators from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the extension or website, your violation of these terms, or your violation of any applicable law or the rights of any third party.

9. Third-Party Services

The extension and website interact with services operated by others, including the Mozilla Add-ons marketplace as the distribution channel, the search service reachable at search.emberpdf.com and its upstream search partner, and the form-forwarding service that delivers messages sent through our contact page. We do not control these services and are not responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.

10. Termination

We may suspend or terminate access to the extension, the website or any part of them at any time and without notice, including where we believe these terms have been breached. You may terminate these terms at any time by uninstalling the extension and ceasing to use the website. Sections 4, 6, 7, 8 and 11 survive termination.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these terms is subject to the exclusive jurisdiction of the state and federal courts located in California.

Nothing in this section deprives you of the protection of the mandatory consumer law of your country of residence. In particular, users in the European Economic Area and the United Kingdom do not waive any rights under the General Data Protection Regulation, and may bring proceedings in their local courts where local law provides that right.

12. Changes to These Terms

We may revise these terms at any time. When we do, we will update the effective date shown at the top of this page, and material changes will be reflected in that date. Continued use of the extension or website after a revision constitutes acceptance of the revised terms. If you do not accept them, uninstall the extension and stop using the website.
